Who we are
Would You Make It? (the "Game") is operated by Tracy Tenney, a sole proprietor ("we", "us"). When you use the Game or buy the Horror Pack, you are contracting with Tracy Tenney. Contact: support@wouldyoumakeit.com.
Acceptance
By accessing or continuing to use the Game, you agree to these Terms. If you do not agree, please do not use the Game.
The Game and content notice
The Game is a browser-based, text-driven branching horror story. Horror Night is free. The Horror Pack is an optional one-time purchase that unlocks five additional worlds. The Game contains fictional horror themes, including peril, death, and frightening situations, and is intended for players aged 13 and older. If you are under the age of majority where you live, you need a parent or guardian's permission to make a purchase.
Purchases and payment
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, taxes, and refund mechanics are governed by Paddle's Buyer Terms. The Horror Pack is a one-time purchase, not a subscription. See our Refund Policy.
License
We grant you a limited, personal, non-exclusive, non-transferable license to play the Game and, if purchased, the Horror Pack worlds, for non-commercial use. Your unlock is tied to the device where you bought it and can be restored on another device using the email used at checkout.
Acceptable use
You agree not to:
- use the Game for any unlawful purpose or in violation of any law;
- commit fraud, including fraudulent purchases, chargeback abuse, or attempts to unlock paid content without paying;
- send spam or abuse the restore-code or support systems;
- copy, resell, or redistribute the Game's stories, artwork, or code, or otherwise infringe our intellectual property;
- interfere with the Game's security, including introducing malware, probing for vulnerabilities, scraping, or reverse engineering.
Intellectual property
Tracy Tenney owns the Game and all related intellectual property, including its stories, text, artwork, software, and branding. Nothing in these Terms transfers ownership to you.
Service availability
We work to keep the Game running, but we do not guarantee it will be uninterrupted or error-free. To the fullest extent permitted by law, the Game is provided "as is" without implied warranties.
Suspension and termination
We may suspend or end access to the Game or to a Horror Pack unlock for material breach of these Terms, non-payment (including refunded or charged-back purchases), security or fraud risk, or repeated or serious violations of these Terms.
Limitation of liability
To the fullest extent permitted by law, our total liability relating to the Game is limited to the amount you paid us in the 12 months before the claim, and we are not liable for indirect or consequential damages. Nothing here limits liability that cannot be limited by law.
Changes
We may update these Terms. The effective date above shows when they last changed. Continued use means you accept the updated Terms.
Governing law
These Terms are governed by the laws of the place where Tracy Tenney resides, without affecting any mandatory consumer rights you have where you live.
